BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That Chapter 2, Code of Ordinances, entitled “Administration,” relating to the Classification and Compensation Plan, is hereby amended by repealing Sections 2-231, 2-301, 2-1076, 2-1077, 2-1078, 2-1079, and 2-1080 and enacting in lieu thereof new sections of like numbers and subject matters, to read as follows.

 

Sec. 2-231. Powers and duties of director.

 

(a)                     The fire chief shall serve as the director of the fire department and shall have the authority necessary to perform the duties specified in the Charter and shall have charge of all employees, buildings and equipment used for this purpose. The fire chief shall have the authority to promulgate and adopt rules and regulations for the management of the fire department, not inconsistent with the Charter or ordinances, and to impose penalties for the violation of such rules and regulations.

 

(b)                     The fire chief shall serve as the principle administrator for providing prehospital emergency medical services throughout the city. The fire chief shall organize and operate the fire department to provide emergency medical services and ambulance services within the city as set forth in chapter 34 and in accordance with any rules or regulations promulgated by the city manager.

 

Sec. 2-301. Duties of city attorney.

The city attorney shall be the director of the law department and may also be referred to as city counselor. It shall be the duty of the city attorney, in addition to the duties imposed upon him by the city Charter, to:

(1)                       Advise council and city officers. To advise the council or its committees or any city officer, when thereto requested, upon all legal questions arising in the conduct of city business.

(2)                       Revise ordinances. To revise ordinances before being passed when submitted to him by any committee of the council.

(3)                       Give opinions. To give his opinion in writing when thereto requested, upon any matter or question submitted to him by the council or any of its committees, or any city officer.

(4)                       Attend council meetings. To be present in person or represented by one of his assistants, designated by him, at all meetings of the council during its entire continuance for the purpose of giving the council any legal advice requested by its members.

(5)                       Keep records of suits. To keep a complete record of all suits brought against the city, giving the names of the parties, the court where brought, the nature of the action, the disposition of the case and the briefs of counsel, and deliver such record to his successor in office.

(6)                       Prosecute offenders and defend officials. To prepare all charges and complaints against parties for violations of the city ordinances, and to appear daily before the municipal court to prosecute all offenders against the laws and ordinances of this city. The city counselor or an assistant city counselor shall defend city officials in all courts in all matters brought on account of official acts except those in which the city, itself, has brought the action, and shall appear and prosecute in the circuit court of the county in all cases taken by appeal from the municipal court.

 

Sec. 2-1076. Salary schedules for occupational group classified as clerical, fiscal, and administrative with class code, class title, and pay grade therein.

Section 2. That Chapter 2, Code of Ordinances, entitled “Administration,” relating to the Classification and Compensation Plan, is hereby amended by repealing Section 2-1081 and enacting in lieu thereof a new section of like number and subject matter, to read as follows.

 

 

 

Sec. 2-1081. Salary schedule for elective positions in the city service.

 

(a) The following schedule for elective positions in the City service is hereby adopted as the standard annual salary schedule for the following positions in the city service as set out herein below:

(b) This annual salary will remain the same and will not be increased at the beginning of any new fiscal year until the salary of a Missouri Circuit Court Judge exceeds this salary. At the beginning of any new fiscal year after the salary of a Missouri Circuit Court Judge exceeds the salary listed in subsection (a), the annual salary of a Judge of the Municipal Court shall equal the salary of a Circuit Court Judge.

 

(c) The annual salary of the part-time Housing Court Judge set out above is based upon a thirty (30) hour workweek. This annual salary may be enlarged from time to time to accommodate changes in workload as designated by Council pursuant to the formula provided in Section 2-1404, Code of Ordinances.

 

Section 3. That Chapter 2, Code of Ordinances of the City of Kansas City, Missouri, is hereby amended by repealing Section 2-1082 enacting in lieu thereof a new section of like number and subject matter, to read as follows.

 

Sec. 2-1082. - Salary schedule for Council members.

 

(a)                     The following schedule for council members in the city service is hereby adopted as the standard annual salary schedule for the following positions in the city service as set out herein below:

(b)                     This annual salary will remain the same and will not be increased at the beginning of each new fiscal year; however this annual salary shall be adjusted at the beginning of each four- year term of office for the positions by a percentage equal to any percentage increase given to the position of Elective Mayor at that time.

 

(c) The council members may also receive a monthly automobile allowance which will be adjusted at the beginning of each fiscal year according to the prior year's Kansas City Consumer Price Index.

 

Section 4. That Chapter 2, Code of Ordinances of the City of Kansas City, Missouri, is hereby amended by repealing Section 2-1083 enacting in lieu thereof a new section of like number and subject matter, to read as follows.

Sec. 2-1083. Salary schedule for Mayor.

(a)                     The following schedule for mayor in the city service is hereby adopted as the standard annual salary schedule for the following position in the city service as set out herein below:

(c)                     The Mayor may also receive a monthly automobile allowance which will be adjusted at the beginning of each fiscal year according to the prior year’s Kansas City Consumer Price Index.

Section 5. That appropriation from the following account is reduced by the following amount:

Section 7.  Directing the City Manager to evaluate elected officials in the employee retirement system and, if deemed feasible, to develop a plan for such inclusion. 

 

Section 8.  That Sections 3 and 4 of this ordinance shall take effect August 1, 2023.  All other sections shall take effect pursuant to Section 503 of the City Charter.
