Declaring it necessary to dedicate City property as street right of way for N.W. Prairie View Road, as part of KCMO Project Number 89008174 - “N.W. Prairie View Road and north of 64th Street - Improvements”, the same being on file in the Office of the Director of Public Works and being incorporated herein by reference, all in Kansas City, Platte County, Missouri; and upon the effective date of this ordinance, the City Clerk is hereby directed to record this ordinance in the Office of the Recorder of Deeds for Platte County, Missouri.

WHEREAS, the City of Kansas City with the adoption of Ordinance No. 080150 on March 6, 2008, modified the City’s Major Street Plan in the vicinity of Interstate 29 and Route 45; and 

 

WHEREAS, the City of Kansas City with the adoption of Ordinance No. 090632 on July 30, 2009, authorized the Director of Public Works to execute a Municipal/Road Relinquishment Agreement with the Missouri Highways and Transportation Commission which required the City to relocate N.W. Prairie View Road north of Route 45 by the year 2017; and

 

WHEREAS, the City of Kansas City with the adoption of Ordinance No. 120425 on June 7, 2012, authorized the changing and re-establishing of grades on N.W. Prairie View Road from Route 45 to the north approximately 1700 feet; NOW, THEREFORE,

 

BE IT ORAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That City property commonly known as 6550 N.W. Prairie View Rd. as well as City property lying to the north of and adjoining 6550 N.W. Prairie View Road be dedicated as street right of way for N.W. Prairie View Road, as part of KCMO Project Number 89008174 - “N.W. Prairie View Road and north of 64th Street - Improvements”, the same being on file in the Office of the Director of Public Works and being incorporated herein by reference, all in Kansas City, Platte County, Missouri; said property to be dedicated as street right of way is described as follows:

 

A tract of land in the southeast quarter of Section 19, Township 51 North, Range 33 West of the 5th Principal Meridian in Kansas City, Platte County, Missouri being bounded and described as follows:

 

Commencing at the Southeast corner of said Southeast Quarter; thence North 00 degrees 47 minutes 47 seconds east, along the east line of said Southeast Quarter 1,143.06 feet; thence North 89 degrees 07 minutes 54 seconds West, 458.59 feet to a point on the Southwesterly right of way line of Interstate Highway Route 29, as now established, said point being the Point of Beginning of the tract of land to be herein described; thence continuing North 89 degrees 07 minutes 54 seconds west, 44.35 feet to a point on the West right of way line of N.W. Prairie View Road; thence Southerly, along said West right of way line, on a curve to the right, having an initial tangent bearing of South 02 degrees 27 minutes 21 seconds west with a radius of 270.00 feet, a central angle of 37 degrees 48 minutes 01 seconds and an arc distance of 178.13 feet; thence South 40 degrees 15 minutes 22 seconds west, continuing along said West right of way line, 7.95 feet; thence South 89 degrees 07 minutes 54 seconds east, 74.58 feet to the East right of way line of N.W. Prairie View Road; thence Northerly, along said East right of way line, on a curve to the left, having an initial tangent bearing of North 33 degrees 24 minutes 13 seconds east with a radius of 330.00 feet, a central angle of 27 degrees 39 minutes 24 seconds and an arc distance of 159.29 feet to a point on the Southwesterly right of way line of Interstate Highway Route 29, as now established; thence North 34 degrees 23 minutes 58 seconds west, along said southwesterly right of way line, 25.22 feet to the POINT OF BEGINNING. Containing 11,672 square feet or 0.27 acres, more or less.

A tract of land in the Southeast Quarter of Section 19, Township 51 North, Range 33 West of the 5th Principal Meridian , as recorded in Book 1236, Page 121 in Kansas City, Platte County, Missouri and described as follows:

 

Commencing at the Northwest corner of Lot 1, DONCRO CENTER, a subdivision in said Kansas City, Platte County, Missouri; thence South 89 degrees 07 minutes 54 seconds east, along the North line of said Lot 1, 250.00 feet to the POINT OF BEGINNING of the tract of land to be herein described; thence continuing South 89 degrees 07 minutes 54 seconds east, 44.35 feet to a point on the Southwesterly right of way line of Interstate Highway Route 29, as now established; thence North 34 degrees 23 minutes 39 seconds West, along said Southwesterly right of way line, 77.5 feet; thence South 00 degrees 52 minutes 06 seconds west, 62.71to the POINT OF BEGINNING.  Containing 1,390 square feet or 0.03 acres, more or less.

 

Section 2. That upon the effective date of this ordinance, the City Clerk is hereby directed to cause this ordinance to be recorded in the office of the Recorder of Deeds for Kansas City, Platte County, Missouri.
