Directing the City Manager or their designee to engage and negotiate with providers of software platforms facilitating peer-to-peer rental car operations in the City of Kansas City for the purpose of administering and collecting all currently applicable taxes and fees.

WHEREAS, Rental car agency means an individual person or business entity as described in Chapter 40 Article II Section 40-61 that engages in the business of renting, leasing or letting passenger vehicles for compensation, whether the provision of such service is the primary, secondary, or incidental business of such person or entity; and
WHEREAS, Ordinance No. 230843 authorized the Director of Aviation to execute a Peer-to-Peer Agreement with Turo, Inc. to provide car sharing services at Kansas City International Airport; and
WHEREAS, the Aviation Department has since entered into an agreement ensuring that Turo, Inc. is subject to the same fee required of concessionaires at the Kansas City International Airport; and
WHERAS, vehicle owners who make their vehicles available for use by the public for financial consideration, by allowing the public to make reservations for the vehicles from the owners through a software platform, are engaged in the business of renting, leasing or letting passenger vehicles for compensation as described in Chapter 40 Article II Section 40-166 of this Code.
WHEREAS, the City Council desires to improve enforcement of the rental car license fee imposed by Section 40-166, Code of Ordinances, on those owners offering their vehicles for rent through online hosting platforms such as Turo; and
WHEREAS, uniform enforcement of policy relevant to rental car agencies ensures uniform treatment of rental car agencies, including peer-to-peer operators, which fall under the definition of Rental car agency as described in Chapter 40 Article II Section...
