Authorizing the Director of City Planning and Development to execute a conditional waiver deferring the completion of certain conditions required under a Development Agreement related to the development of certain property generally located along N. Arlington Avenue, north of N.E. Parvin Road in Kansas City, Missouri.

WHEREAS, the City entered into a development agreement (“Development Agreement”) dated as of August 3, 2020, related to certain property generally located along N. Arlington Avenue, north of N.E. Parvin Road in Kansas City, Missouri, pursuant to Ordinance No. 200526; and
WHEREAS, the Development Agreement requires that certain conditions be met for each lot prior to the issuance of a building permit for such lot; and
WHEREAS, City Planning Commission approved a Project Plan for a multi-phased development on one lot of the project area governed by the Development Agreement, under CD-CPC-2023-00157; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF KANSAS CITY:
Section 1. That the Director of City Planning and Development is authorized to execute a conditional waiver related to the Development Agreement for the purposes of allowing the completion of Conditions a., b. and d. listed under Section 2 of the Development Agreement to be deferred to the issuance of the certificate of occupancy for the last building of the second phase of the development shown on the Project Plan.
