Authorizing a Cooperative Agreement for Water Purchase between the City of Mosby, Missouri and Kansas City, Missouri, for a period of twenty-five (25) years.

WHEREAS, the City of Mosby, Missouri desires to enter into a Water Purchase Agreement to purchase water from Kansas City, Missouri; and

WHEREAS, the City of Mosby, Missouri desires to contract for a maximum quantity of 0.6 million gallons per day (MGD), allocated to one point of service; and

WHEREAS, the City of Mosby, Missouri agrees to construct, at City of Mosby’s expense, a metering/regulating facility to purchase water from Kansas City, Missouri; and

WHEREAS, the City of Mosby, Missouri will be responsible for the capital costs for connection to Kansas City’s Main near Highway 69 and Rhodus Road, including but not limited to any line extensions, easements, permits, master meter, meter pit and connection fees; and

WHEREAS, Kansas City, Missouri is willing to deliver and sell water to the City of Mosby, Missouri in accordance with the terms and conditions set forth herein; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the Director of Water Services is hereby authorized to execute, on behalf of Kansas City, a Cooperative Agreement for Water Purchase between the City of Mosby, Missouri and Kansas City, Missouri, for a period of twenty-five (25) years. A copy of the agreement is on file in the office of the Director of Water Services.
