RESOLUTION - Directing the City Attorney, within the bounds of the City Charter, to join, intervene, or otherwise participate in the lawsuit entitled City of St Louis, et al. v. State of Missouri, et al., 21AC-CC00237-01, currently pending in the Circuit Court of Cole County and which challenges the constitutionality of Sections 1.410 to 1.485 of the Revised Statutes of Missouri known as the “Second Amendment Preservation Act.”

WHEREAS, the Missouri Second Amendment Preservation Act (SAPA) purports to invalidate numerous federal firearms laws and to implement that invalidation through directives to state courts and law enforcement officials, as well as through civil penalties against state and local agencies; and
WHEREAS, the City of Kansas City, Missouri (the “City”), a Charter City within the State of Missouri, provides funding for the Kansas City Police Department (KCPD); and
WHEREAS, the KCPD licenses officers of the Kansas City Airport Police Division and the Kansas City Parks and Recreation Department’s Park Rangers program, all employees of the City, as Class A licensees pursuant to Mo. Code Regs. Ann. tit. 17, § 10-2.030; and
WHEREAS, SAPA poses a clear and substantial threat to public safety and monetary harm within the City of Kansas City; NOW, THEREFORE,
BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:
That the Mayor and Council hereby direct the City Attorney, within the bounds of the City Charter, to join, intervene, or otherwise participate in the lawsuit entitled City of St Louis, et al. v. State of Missouri, et al., 21AC-CC00237-01, currently pending in the Circuit Court of Cole County and which challenges the constitutionality of Sections 1.410 to 1.485 of the Revised Statutes of Missouri known as the “Second Amendment Preservation Act.”
