Authorizing the Director, Chief Engineering Officer, and Utility Asset Manager of the Water Services Department to act as the City’s designated authorized representatives for participation by the City, through its Water Services Department, in the American Rescue Plan Act (ARPA) in accordance with federal requirements administered by the U.S. Department of the Treasury and state requirements administered by the Missouri Department of Natural Resources; and directing the Director of Water Services to report back to Council with an update on the grants awarded by October 31, 2022.

WHEREAS, Kansas City, Missouri intends to file an application with the Missouri Department of Natural Resources Financial Assistance Center’s State ARPA Grant Programs for a subaward of federal financial assistance provided to the State of Missouri by the U.S. Department of the Treasury (“Treasury”) pursuant to Section 602(b) of the Social Security Act, as added by Section 9901 of the American Rescue Plan Act, (Pub. L. No. 117-2 (March 11, 2021), 135 Stat. 4, 223-26 (“Act”); and
WHEREAS under the terms of section 602(c) of the Act and Treasury’s regulations, the State of Missouri has authorized the making of grants to authorized applicants to aid in the completion of specific public projects related to lead service line inventory, drinking water, wastewater, and/or stormwater; and
WHEREAS, the Missouri Department of Natural Resources has requested that the City designate individuals authorized to execute documents on behalf of Kansas City, Missouri; NOW, THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section 1. That, on behalf of the City, the Director, Chief Engineering Officer, and Utility Asset Manager of the Water Services Department are hereby authorized to furnish such information as the Missouri Department of Natural Resources may reasonably request in connection with the application, to sign all necessary documents on behalf of the applicant, to furnish such assurances to the Missouri Department of Natural Resources as may be required by law or regulation, and to receive payment on behalf of the applicant.
Section 2. That the Director of Water Services is to report back to Council with an update on the grants awarded by the State’s ARPA Grant Program by October 31, 2022.
