Estimating and appropriating revenue in the amount of $900,000.00 in the Capital Improvements Fund for the Northeast 104th Street Improvements - North Willow Avenue to North Church Road project; authorizing the Director of Public Works to execute a cooperative agreement with the City of Liberty, Missouri in the amount of $2,371,322.00 for related transportation improvements; designating requisitioning authority; and recognizing this ordinance as having an accelerated effective date.

WHEREAS, Committee Substitute for Ordinance No. 120042 authorized the City to enter into a Settlement Agreement with Clay County to fund road and bridge projects at a specified rate from 2013 through 2026; and
WHEREAS, under the Settlement Agreement, Clay County remits annual road and bridge funding totaling $900,000 through 2026, and these revenues provide support for transportation improvements within Kansas City, including the Northeast 104th Street Improvements project; and
WHEREAS, Kansas City and the City of Liberty, Missouri, desire to jointly construct roadway, sidewalk, trail, and related transportation improvements along Northeast 104th Street-from approximately 780 feet east of North Willow Avenue to North Church Road-which lies within both municipalities and for which the parties intend to cooperatively share responsibilities and project costs; and
WHEREAS, the total estimated cost of the project is $5,358,920.00, to be prorated between the parties based on the length of the project located within each municipality; and
WHEREAS, under the cooperative agreement with the City of Liberty, Missouri authorized for execution by this ordinance, Kansas City’s share of project costs is $2,371,322.00, and Liberty’s share is $2,987,598.00; NOW, THEREFORE
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section 1. That revenue in the amount of $900,000.00 is hereby estimated in the Capital Improvements Fund to the following account:
26-3090-890000-480190 Road & Bridge Tax-Clay County $900,000.00
Section 2. That the sum of $900,000.00 is hereby appropriated from the Unappropriated Fund Balance of the Capital Improvements Fund to the following account:
26-3090- 896124-B-89008997 NE 104th St-N Willow-N Church $900,000.00
Section 3. That the Director of the Public Works Department is hereby authorized to execute a cooperative agreement in the amount of $2,371,322.00 with the City of Liberty, Missouri for transportation improvements in the NE 104th St Improvements - N Willow Ave to N Church Rd project from funds previously appropriated to the following accounts:
26-2080-898011-B-89008997 NE 104th St-N Willow-N Church $ 500,000.00
26-1000-898011-B-89008997 NE 104th St-N Willow-N Church 1,000,000.00
26-3090-896124-B-89008997 NE 104th St-N Willow-N Church 871,322.00
TOTAL: $2,371,322.00
Section 4. That the Director of Public Works is hereby designated as requisitioning authority for Account No. 3090-896124-B.
Section 5. That this ordinance, being an ordinance relating to the appropriation of money and the expenses of government, is hereby recognized as having an accelerated effective date pursuant to Sections 503(a)(3)(b) and 503(a)(3)(c) of the City Charter and shall take effect in accordance with Section 503 of the Charter.
