Authorizing Amendment No. 3 to a Design Professional Services Agreement with TranSystems Corporation in the amount of $1,000,000.00 for the N.E. 112th Street Improvements project for a total contract amount of $1,705,700.00; and recognizing this ordinance as having an accelerated effective date.

WHEREAS, the Director of Public Works authorized a Design Professional Services Agreement with TranSystems Corporation in the amount of $355,315.00 to perform a design study for the overall project and provide final plans for N. Stark Avenue improvements; and
WHEREAS, the Director of Public Works authorized Design Professional Services Agreement Amendment No. 1 with TranSystems Corporation in the amount of $39,785.00 for additional design study scope items; and
WHEREAS, City Council approved Ordinance No. 220234 which authorized Design Professional Services Agreement Amendment No. 2 in the amount of $310,600.00 for construction phase services and field observation for N. Stark Avenue improvements; and
WHEREAS, Amendment No. 3 is needed to complete final design for N.E. 112th Street improvements from N. Stark Avenue to the east City Limits, including a new bridge over Fishing River Tributary and limited construction phase services; and
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section 1. That the Director of Public Works is hereby authorized to execute a Design Professional Services Agreement Amendment No. 3 with TranSystems Corporation in the amount of $1,000,000.00 for Project No. 89008835 (formerly 89008700) - N.E. 112th Street from N. Stark Avenue to the east City Limits - for a total contract amount of $1,705,700.00. A copy of the amendment is on file in the Public Works Department.
Section 2. That the Director of Public Works is hereby authorized to expend the sum of $1,000,000.00 from funds previously appropriated to Account No. 24-3090-898101-B-89008835.
Section 3. That the Civil Rights and Equal Opportunity Department, to assure fair representation by socially and economically disadvantaged groups, approved for the amended design contract a fifteen percent (15%) representation by Minority Owned Businesses and a ten percent (10%) representation by Women Owned Businesses.
Section 4. That this ordinance, relating to the design, repair, maintenance or construction of a public improvement, is recognized as an ordinance with an accelerated effective date as provided by Section 503(a)(3)(D) of the City Charter and shall take effect in accordance with Section 503, City Charter.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
