RESOLUTION - Authorizing the City Manager to file an application for the Promoting Resilient Operations for Transformative, Efficient, and Cost-Saving Transportation (PROTECT) grant from the U.S. Department of Transportation (U.S. DOT) for resiliency improvements addressing traffic safety, surface transportation reliability, and stormwater management in and around East 63rd Street and The Paseo Boulevard.

WHEREAS, on September 27, 2010, a federal judge signed the Consent Decree requiring Kansas City to reduce the volume of wet weather sewer overflows into local creeks, streams, and rivers with amendments to that decree in 2015, 2018, and 2021; and
WHEREAS, the Consent Decree requires capturing 85 percent of Typical Year wet weather flow in the Town Fork Creek watershed by 2040; and
WHEREAS, the Mid-America Regional Council awarded a Surface Transportation Block Grant to the City for improvements at East 63rd Street and The Paseo Boulevard, which are funds that can be leveraged as municipal match for the PROTECT match requirement; and
WHEREAS, the PROTECT grant program provides a funding opportunity to reduce surface transportation infrastructure flooding at various locations within the Town Fork Creek watershed in the vicinity of East 63rd Street, Meyer Boulevard, and The Paseo Boulevard; and
WHEREAS, KC Water continues to design a series of major green infrastructure and sewer separation projects in the Town Fork Creek watershed and this green infrastructure can be designed to reduce street flooding while supporting Consent Decree compliance; and
WHEREAS, the City estimates a total project cost for the PROTECT grant project submission of $51,000,000.00, including an 80 percent federal funding request of $40,800,000.00 and a local match of $10,200,000.00; NOW, THEREFORE,
BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:
Section 1. That the City Manager is hereby authorized to execute and file an application on behalf of the City of Kansas City with the U.S. DOT for a grant to aid in the design and construction of roadway and stormwater improvements for the 63rd Street Junction & Watershed Resiliency Improvements Project.
Section 2. That the City Manager is hereby authorized and directed to furnish such information as the U.S. DOT may reasonably request in connection with the application which is herein authorized, to sign all necessary documents on behalf of the applicant, furnish such assurances to the U.S. DOT required by statute or regulation, and receive payment on behalf of the applicant.
