Authorizing the Director of General Services to execute a Second Amendment to Lease Agreement with ENGLEWOOD SC L.L.C., a Delaware limited liability company (“Lessee”) for the purpose of a ground lease, monument, and pylon sign for the common benefit of tenants and owners of the adjoining shopping center known as Creekwood Commons, generally located at the Northeast corner of Englewood Road and North Oak Trafficway, Kansas City, Clay County, Missouri.

WHEREAS, the City owns rights in certain real property that includes the leasehold premises identified as Creekwood Commons, generally located at the Northeast corner of Englewood Road and North Oak Trafficway, Kansas City, Clay County, Missouri (“Premises”); and
WHEREAS, the City entered into that certain Lease with North Oak Retail Partnership, a Colorado general partnership (“North Oak”) effective March 30, 1988; and
WHEREAS, North Oak assigned its interest in the ground lease to Creekwood Commons, LLC in May of 2007; and
WHEREAS, Big Creekwood Commons, LLC, a Delaware limited liability company, assigned the Lease to Lessee in January of 2023; and
WHEREAS, the City and Lessee desire to extend the term of the Ground Lease and amend the terms as more specifically set forth herein; NOW, THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section 1. That the Director of General Services Department is authorized to extend the term of the ground lease agreement with Englewood SC L.L.C., a Delaware limited liability company for the purpose of a ground lease, monument, and pylon sign for the common benefit of tenants and owners of the adjoining shopping center known as Creekwood Commons, for a period of thirty-nine years renewal beginning January 12, 2023 and ending January 31, 2062. A copy of the lease agreement is on file in the General Services Department.
