Approving the design of the proposed Three Light Skybridge and authorizing the issuance of an encroachment permit for the structure.

WHEREAS, the Three Light Project consisting of a multi-family residential building with approximately 288 residential units and approximately 7,500 square feet of retail space is planned to be constructed upon land generally bounded by Walnut Street on the east, East 14th Street on the north, East Truman Road on the south and Main Street on the west; and

                     WHEREAS, the developer of the project proposes to construct a pedestrian skybridge above Walnut Street connecting the Three Light structure to the existing Two Light structure located at 1444 Grand Boulevard; and

WHEREAS, the design of arches, bridges, structures and approaches which are the property of any corporation or individual, and which shall extend upon any street, avenue, highway, park or property belonging to the City is subject to the approval of the Municipal Arts Commission; and

WHEREAS, the Three Light Skybridge was reviewed administratively as part of the Urban Redevelopment development plan approval process and approved with the condition that the developer obtain an encroachment permit pursuant to Chapter 18 of the Code of Ordinances; and

WHEREAS, the City Council passed Ordinance No. 210430, As Amended, which dispensed with the Municipal Arts Commission’s approval process of the Three Light Skybridge utilizing Sec. 1137(c) of the City Charter; and

WHEREAS, Ordinance No. 210430, As Amended, directed the City Manager to require the Director of City Planning and Development to coordinate with the developer to review the design of the skybridge and present the design of the skybridge to the City Council for review and final approval before an encroachment permit is issued; and

WHEREAS the Director of City Planning and Development has coordinated with the developer to reach a consensus on the final design of the skybridge to present to the City Council for their review and approval; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That, as directed by the City Manager, the Director of City Planning and Development has presented the final design for the Three Light Skybridge, a copy of which is attached to this Ordinance as Exhibit A, to the City Council for their review.

Section 2. That the City Council has reviewed the architectural renderings for the Three Light Skybridge and approves its design, thereby allowing for the issuance of an encroachment permit for this structure.
